HOW IT BEGAN
The ERC was originally established in the CARES Act as a reward to companies that retained employees through the pandemic, thus keeping them off unemployment. However, the ERC was very difficult for most businesses to qualify for, requiring a significant decline (50%) in gross revenues caused by the pandemic…AND a provision where companies taking any PPP (Payroll Protection Plan) money were immediately disqualified. These restrictions led to this provision of the CARES Act to go effectively unutilized.
